Terms and Conditions and Customer Information
1. Basic Provisions
(1) These terms and conditions apply to all contracts made between you as a customer and us (Ponyloop® – ASF Network LTD) via the website Ponyloop®. Unless otherwise agreed, your own terms and conditions will not be accepted.
(2) A “consumer” in the sense of these terms is any natural person acting for purposes which are outside their trade, business or profession. A “business customer” is any person or legal entity acting in the exercise of their trade or profession.
2. Conclusion of Contract
(1) The subject of the contract is the sale of goods.
(2) By listing a product on our website, we make a binding offer to conclude a contract under the terms stated in the product description.
(3) The contract is concluded via our online shopping cart system:
Products intended for purchase are placed in the "cart". You can review and change the cart at any time. After entering your personal data and selecting payment and shipping methods, all order details are displayed again. If you choose an instant payment method (e.g. PayPal, Apple Pay), you may be redirected to the respective provider to complete payment.
Before placing your order, you can review or change the order details or cancel the purchase. By clicking the "Buy Now" button, you accept the offer, and a binding contract is formed.
(4) Order processing and communication are handled via email and partly automated. You must ensure the email address provided is correct and that emails from us can be received.
3. Right of Retention and Ownership
(1) You may only exercise a right of retention if it relates to claims arising from the same contract.
(2) The goods remain our property until full payment has been received.
4. Warranty
(1) Statutory warranty rights apply.
(2) As a consumer, please check the goods upon delivery for completeness, obvious defects, and transport damage. Not reporting such issues does not affect your legal warranty rights.
5. Governing Law
(1) The laws of England and Wales shall apply. If you are a consumer, this choice of law only applies to the extent that it does not deprive you of mandatory consumer protection rights in your country of residence.
(2) The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
